These terms and conditions (“terms”) set out the basis on which Forward Focus Logistics LLC will transport packages, documents and envelopes (“packages”) and palletised goods (“pallets”; pallets and packages are together “shipments”). These terms are as per current applicable agreed terms with customers in the service agreement. The service agreement contains important details about the services of Forward Focus Logistics LLC which the customer should read and which form part of the agreement between Forward Focus Logistics LLC and the customer. Depending on the country where the shipment is presented to Forward Focus Logistics LLC for carriage. The service agreement will mean and the shipper’s contract will be with the Forward Focus Logistics LLC authorised service agents, or the Forward Focus Logistics LLC entity if existing, in the country where the shipment is presented for carriage, who may be contacted c/o Forward Focus Logistics LLC (office at 09 – 114, Tower 4, 8th Floor, DWTC, Dubai, UAE (although this shall not be taken in itself as choosing domicile or conferring jurisdiction on any court).
A shipment may be carried via any intermediate stopping places that Forward Focus Logistics LLC deems appropriate. Forward Focus Logistics LLC may engage sub-contractors to perform services and contracts both on its own behalf and on behalf of its servants, agents and sub-contractors each of whom shall have the benefit of these terms.
Unless any special services are agreed, and subject to these terms, the service to be provided by Forward Focus Logistics LLC is limited to the pickup, transportation, customs clearance where applicable, and delivery of the shipment. The shipper acknowledges that shipments will be consolidated with those of other shippers for transport and that Forward Focus Logistics LLC may not monitor the inbound and outbound movement of individual shipments at all handling centres. Forward Focus Logistics LLC is not a common carrier and reserves the right in its absolute discretion to refuse carriage to any shipment tendered to it for transportation.
Forward Focus Logistics LLC shall provide the Customer with express transportation & freight services to & from 220 countries & territories through its partners which the Customer has elected to purchase through Forward Focus Logistics LLC and which are further described below:
Forward Focus Logistics LLC. In the event of any circumstances outside of the reasonable control of Its Carriers & Agents, including, but not limited to, epidemics, pandemics, any governmental actions, or associated capacity restrictions, Forward Focus Logistics LLC may discontinue, amend services or restrict the availability of services immediately, and Forward Focus Logistics LLC / Its Carriers & Agents shall be relieved of any liability (including for service disruption, non-performance or delays) in case of such events.
Without exception, all services procured by the Customer they shall be provided by Forward Focus Logistics LLC through its Carriers & Agents Terms and Conditions of Carriage in Schedule 1 (“Forward Focus Logistics LLC Conditions”) which are deemed to be incorporated herein.
The rates are set out in Schedule 2 (as per the provided rates confirmed to you by Forward Focus Logistics LLC).
Rates will be subjected to an annual price increase, and these will be adjusted according with the existing published rates.
Forward Focus Logistics LLC / Its Carriers & Agents reserves the right to make emergency surcharges to recover costs associated with temporary emergency situations beyond our control that could not be reasonably anticipated at the commencement of this Agreement. All such surcharges will be temporary and will apply in addition to the Rates. The customer will receive a written notice of any emergency surcharge, describing the reasons for such surcharges.
When a shipment requires customs clearance, it is the shipper’s obligation to provide, or to ensure that the receiver will provide, Forward Focus Logistics LLC with complete and accurate documentation for the purpose but Forward Focus Logistics LLC will, unless instructed otherwise, act on behalf, at the expense and at the risk of the shipper or receiver in obtaining customs clearance. Provided that, in the case of shipments whose points of dispatch and destination are both within the same customs area, Forward Focus Logistics LLC only performs customs clearance if instructed to do so. The shipper or receiver also agrees that Forward Focus Logistics LLC may be considered as being the receiver of the package or the shipment for the sole purpose of appointing a customs broker to carry out any customs clearance insofar as is allowed by law.
The Rates and Charges applicable to the Services are attached in Schedule 2 and are payable in accordance with the terms of Invoicing. Forward Focus Logistics LLC invoices are not accompanied by proof of delivery for each shipment. These can be made available at an extra charge. Invoices shall be payable within 30 days from the invoice date. Queries on invoices should be raised within 7 days of submission otherwise such invoices shall be deemed to have been accepted by the customer. All duties and taxes paid by Forward Focus Logistics LLC / Its Carriers & Agents shall be fully reimbursed by the Customer in cash upon delivery of the shipment. Payments shall be made by direct debit, where applicable.
If Forward Focus Logistics LLC is unable to start or continue with carriage of the shipper’s shipment for a reason beyond its control, Forward Focus Logistics LLC will not be in breach of its agreement with the shipper but will take all steps that are reasonably practicable in the circumstances to commence or continue the carriage. Examples of events beyond Forward Focus Logistics LLC control are disruption to air or ground transportation due to bad weather, fire, flood, war, hostilities, civil disturbance, acts of government or other authorities (including, without limitation, customs), labour disputes or obligations affecting Forward Focus Logistics LLC or some other party, delays in customs clearance and/or delays or other issues arising out of or otherwise related to the UK ceasing to be a member of the EU.
The Consignment Note is non-negotiable and the shipper acknowledges that it has been prepared by the shipper, or Forward Focus Logistics LLC on behalf of the shipper. The shipper warrants that he/she is still the owner of the goods transported hereunder, or that he/she is the authorized agent of any other person having any interest in the shipment.
2.2 The shipper understands and agrees that Forward Focus Logistics LLC / Its Carriers & Agents may abandon and/or release any shipment or part thereof consigned to the Carriers / Agents through Forward Focus Logistics LLC which has been declared unacceptable, which has been undervalued, or is misdeclared whether intentionally or not without incurring any liability whatsoever, and will save, defend, and hold Forward Focus Logistics LLC / Its Carriers & Agents harmless from all claims or damages therefrom.
2.4 The shipper understands and agrees that Forward Focus Logistics LLC is not a common carrier, and that Forward Focus Logistics LLC reserves the right at its sole discretion to refuse or abandon the carriage or transportation of any particular goods for any person, firm, entity, company, or corporation, and the carriage or transportation of any class of goods whatsoever.
Forward Focus Logistics LLC / Its Carriers & Agents has the right to inspect any shipment but are under no obligation to do so. If it does so it shall be entitled to open the shipment and examine any package therein. In that event, Forward Focus Logistics LLC / Its Carriers & Agents will exercise reasonable care but it shall not be liable for any damage to the shipment or any delay of the shipment arising as a result of such examination.
Forward Focus Logistics LLC / Its Carriers & Agents shall have a lien on all goods transportation for all freight charges, Customs Duties, advanced or other charges of any type arising out of transportation hereunder and may refuse to surrender possession of the shipment until all such charges owed are paid.
Direct loss means, the destruction or permanent disappearance of the shipment or physical damage to the shipment or any part thereof while in the custody of Forward Focus Logistics LLC / Its Carriers & Agents. Shipment shall include all documents or merchandise consigned to the Carriers / Agents through Forward Focus Logistics LLC under the Consignment Note.
The liability of Forward Focus Logistics LLC for direct loss is limited to the maximum of:
6.1 The actual value of a document contained in a shipment which term includes any item declared to be of no commercial value, shall be either its actual cost of production, replacement, reconstruction, repair, or reconstitution at the date of shipment shown on the Consignment Note whichever is less.
6.2 The actual value of merchandise in a shipment which term includes any item declared to be of no commercial value, shall be either the actual cost of production, replacement, reconstruction, resale, or reconstitution at the date of shipment shown on the Consignment Note or its resale or fair market value at that date whichever is less, provided that the actual value shall not exceed the original cost of the article paid by the shipper plus 10 percent.
Forward Focus Logistics LLC / Its Carriers & Agents shall not be liable for consequential loss which means any loss or damage other than the direct loss suffered or alleged to have been suffered by the shipper or by any other person in consequence of the carriage of the shipment by Forward Focus Logistics LLC / Its Carriers & Agents, Its Employees or in consequences of any breach by Forward Focus Logistics LLC / Its Carriers & Agents, Its Employees of the agreement to carry the shipment.
Forward Focus Logistics LLC / Its Carriers & Agents shall not be liable for delay which means any delay in the pick-up, transportation, or delivery of any shipment or any missed delivery or non-delivery of any shipment caused by the following:
9.1 Any claims by the consignor / consignee must be notified in writing to Forward Focus Logistics LLC upon the date of delivery. Forward Focus Logistics LLC / Its Carriers & Agents reserves the right to decline to accept any claims not notified within the above stipulated time.
9.2 Emirates Post will be under no liability to accept any claim unless and until the shipper has paid to Forward Focus Logistics LLC all charges due under the agreement. The shipper may not set off the amount of his claim against those charges.
In contracts to which the Warsaw Convention applies, the liability of Forward Focus Logistics LLC / Its Carriers & Agents to the shipper may be further limited. The contract incorporates such provisions of the Convention as may be applicable to it.
12.1 If the shipper wishes to insure the shipment then he must notify/indicate to Forward Focus Logistics LLC in writing at the time of booking or delivering the shipment to Forward Focus Logistics LLC / Its Carriers & Agents stating the nature and value of goods and the extent of the coverage required.
12.2 There is no insurance in force and the shipment remains at the shipper’s risk unless and until the shipper has received the Insurance confirmation from Forward Focus Logistics LLC / Its Carriers & Agents.
12.3 Insurance premium will be charged along with the regular invoice and the shipper shall become liable to pay the full amount of such premium to Forward Focus Logistics LLC.
12.4 Any Insurance coverage arranged by Forward Focus Logistics LLC under the general agreement shall be limited to AED 100.00
12.5 Any insurance cover issued under the agreement shall be subject to such terms and conditions as the insurer shall stipulate.
The shipper and Forward Focus Logistics LLC / Its Carriers & Agents irrevocably agree that the country of origin laws shall apply to every particular and exclusively submit to the sole jurisdiction of the country of origin.
All international shipments must have the bills/invoices and customs declaration.
Upon checking and inspection by Forward Focus Logistics LLC / Its Carriers & Agents, the item is to be packed by the customer according to the item’s (actual or volumetric) weight, type, and content for its safety.
Shipments will be charged on Actual weight or Volumetric Weight whichever is higher.
Forward Focus Logistics LLC / Its Carriers & Agents are not responsible for any delay or detention by Customs authorities at the destination. The customer is fully responsible for any non-compliance and/or discrepancies between the item content and the Customs declaration.
Shipments cannot be delivered to P.O. Boxes or postal codes. Shipments are delivered to the Consignee’s address given by Shipper but not necessarily to the named Consignee personally. Shipments to addresses with a central receiving area will be delivered to that area.
Forward Focus Logistics LLC / Its Carriers / Agents may notify the Consignee of an upcoming delivery or a missed delivery. The consignee may be offered alternative delivery options such as delivery on another day, no signature required, redirection, or self-collection.
Note: Extra fees or levies might be applicable in some destination countries (e.g. Customs duty/VAT) as per countries’ laws & regulations.
These terms and conditions supersede all other terms and conditions, oral or written, and all other communications between the parties suggesting additional or different terms.
Forward Focus Logistics LLC has the right to process data provided by the shipper or receiver in connection with carriage by Forward Focus Logistics LLC, to transfer such data to other group companies and contractors of Forward Focus Logistics LLC, including in other countries which may not have the same level of data protection as the country where the shipment is presented to Forward Focus Logistics LLC, and to have it processed there if and to the extent the transfer and processing of the data in such countries is required for performing the agreed shipment services.
